I will be debating whether or not abortion should be considered legal for all situations. I will take the Con side (i.e. abortion should not be legal in all situations) The debate will last for 4 rounds to accommodate opening arguments, rebuttals, and closing arguments.

I don't know if I am supposed to present an argument, so I will anyways....

In 1969, Teresa Keeler, eight months pregnant, was beaten unconscious by her jealous ex-husband, Robert Keeler, who told her during the attack that he was going to "stomp it out of her." Later, at the hospital, Keeler delivered her little girl, who was still born and suffered from a fractured skull.

Prosecutors attempted to charge Robert Keeler with the beating of his wife and for the murder of the fetus, "Baby Girl Vogt" named with her fathers last name.

The California Supreme Court dismissed the charges, saying that only SOMEONE BORN ALIVE COULD BE KILLED, and that the fetus was not a human being.

Due to public pressure the murder statute was eventually amended to say that murder charges can only apply to fetuses older than seven weeks, or beyond the embryonic stage.

Abortion is needed in the most dire situations.

Although many states now have fetal homicide laws, there are a wide variety of differences about when a fetus is considered living. In Missouri and 17 other states, the laws recognize a fetus as living at the time of conception.

Pro-abortion groups see the laws as a way to undermine Roe v. Wade, although currently statues to the laws clearly exclude legal abortions.

Anti-abortionists view it as a way to teach the public about the value of a human life

Sorry for the confusion, I did intend for you to start you're arguments on that post.

In 2004 the United States Congress passed the "Unborn Victims of Violence Act". This act was passed as a response to the murder of Laci Peterson. Laci was pregnant at the time of her murder and the father of the that child, Scott Peterson, was charged with the murder of both Laci and her fetal son. This act codified that a fetus is considered a victim to acts of violence. It is current law that would state in the case you described the fetus would be considered a victim that is entitled to the same rights as any other human to life.

I would agree that there are some cases in which abortion is should be allowed, those being when the health of the mother is in danger, instances of rape, cases of incest, and situations in which the fetus does not stand a legitimate chance to live due to genetic defects or trauma.

Roe v. Wade based its decision on the right to privacy. This is championed by pro-choice groups as saying that a women has a right to her own body and decisions made about it. However the implication of the Unborn Victims of Violence Act would be that the fetus is not part of the women's body, if it was then the fetus should not be considered a victim. Thus the fetus, harboring the same rights to life as anyone else, has the right to develop and be born into its own life, and that right should not be barred from it by its mother.
