The constitution indicates that any powers not specifically granted to the Federal Government are inherited by the states. Since marriage is not specifically mentioned in the constitution, this was not up to the Supreme Court to decide and should have been left up to the states.

I accept the debate and I would like to thank my opponent for creating the topic. I feel that it should be made clear that I will be arguing that Gay Marriage is legal under Constitutional law, and therefore my opponent will be arguing it is. I hope that the BoP will be shared and I look forward to a good debate.

I doubt anyone will take you up on this debate. Because it is clear that they over stepped their power. The judgement is another federalist political grab for power. Forcing the recognition of marriage contracts from other states. But that where it should end. And it only sets precedence for states not involved in the case, not a repeal or change in the laws of other states.

I think it was like 13 states that didn't issue or recognize gay marriage. I'm pretty sure the tide was changing anyways. But voting at the state level is where it should have been done.

This is a complete injustice and trampling on the check and balance system of the constitution.

@MagicAintReal The recognition of marriage is not illegal, however the federal government taking an implied power of the states (by forcing gay marriage onto them) is.
