Scenario:
Characters: Bob, Susie, and Tony
Bob is Susie's friend, and Tony is Susie's boyfriend.

Bob creates a fake screen shot making it seem as though Susie sent him a nude photograph within the period that she has been dating Tony. Bob does not use an actual picture of Susie, but Tony would not know that. Bob says something along the lines of "Hey, Susie. If you don't want me to send this picture to Tony, you should send me nude photographs."
Not wanting to lose her relationship; thinking that Tony might believe the lie, Susie complies.

My argument is that Bob is innocent of the crime of extortion/blackmail/etc.
Your job is to successfully convince me that Bob has committed a crime.

I accept this debate.

"Extortion is a form of theft that occurs when an offender obtains money, property, or services from another person through coercion."(1).

In this case, the property Bob has obtained is nude pictures, and the coercion he used is the threat of destroying a relationship.

In case someone claims that digital pictures are not "property," most laws also mention that extortion can involve taking "some other thing of value from a victim against his/her will." The scenario is clearly taking something of value against Susie's will.

Many states combine blackmail and extortion under a single law. For instance, in California the statute is known as the California Extortion and Blackmail Law. It carries a penalty of up to four years in prison and a $10,000 fine.

Also, the very act of creating a fake nude picture of someone and showing it to them in a threatening circumstance qualifies as harassment, which is itself a crime.(2)

If this situation is real, Bob should destroy the pictures, both the real ones and the fake ones, and probably consult an attorney. If his friends are exceedingly forgiving, he could come clean and promise never to do anything like this again.

Bob is both a criminal and horrible human being.

Bob should try to make it up to his friends, and show them through actions that what he did was a silly mistake and was meant only as a joke, and ESPECIALLY that it will never happen again.

Is this story based on reality?

The way you presented it, adding stuff like "something along the lines of", makes it seem as if you don't want to get caught bending the truth. That, added to the fact that you joined an hour before I posted and this is literally your first debate, may lead to some suspicions.

Some advice for Bob: he should apoligize to all parties involved and not hold a grudge against anybody. That's probably the cleanest way to get out of the situation with a face.
