Legalize prostitution in the USA.

I think we should legalize prostitution in the USA. I base this on two fronts.

A. Government should not form laws against non-violent sins, AKA separation of church and state.

B. Elimination/reduction of black market of prostitution.

I don't agree that we should not legalize prostitution in the United States.

1. Legalizing prostitution will increase sex trafficking and promote inequality.

2. Legalizing prostitution does not protect the people that are in the sex industry.

I. Intro

Round 2 arguments

I think prostitution should be legalized in the USA for two main reasons. A. Separation of Church and State and B. To reduce crime. There is no logically secular reason to have laws strictly prohibiting prostitution. Furthermore, the most effective way to reduce crime is to legalize the activity.

II. Separation of church and state

The only reason prostitution is against the law now is because people think it is sin. The problem with banning an activity based upon God's divine laws is that this is clearly a breach of the separation between church and state.

"The modern Separation of Church and State doctrine, created by the United States Supreme Court in 1947, prohibits any federal, state or local government preference or support for religion. This federal judicial doctrine generally eliminates religion from the public square." [0]

Impact, any religious reasons for banning prostitution are denied by the supreme court decision in 1947. Sin cannot be used as an excuse to create a law. Since there is no other reason other than sin to ban prostitution, the activity should be legalized. In general, an action is moral and lawful until proven otherwise. Prostitution is a victim-less crime. Both parties are consenting. This is little different than a barber cutting hair or a foot massage.

III. Best way to reduce crime is to legalize the activity

Crime is a problem that any society faces. Some of the most rigid theocracies and police states have huge crime problems. Showing that using the maximum amount of force to solve crime is rarely the answer. Specific to the USA is the war of drugs, prohibition, and sadly enough dog fighting. [1][2][3]

Clearly, simply passing a law to make these activities illegal will not halt these activities. Not only that, but we tie up precious resources fighting against the crimes. [4] We have wasted over one trillion dollars fighting the war on drugs. Considering the national debt of over 19 trillion [5], we cannot afford to to be so inefficient. Not only that but we make a black market more profitable. Immoral habits that arise in the black market that wouldn't happen otherwise.

The best example would be drug lords and mafia murdering innocent humans. Btw, prostitutes are killed sometimes. [6] Simply legalizing the activity would remove much of the violence involved. We don't need a gun to shop at the local pharmacy. Impact, I have shown the disastrous effects of banning similar activities. We can extrapolate the same is true of prostitution.

You might be asking, what about prostitution? Let's look directly at prostitution. [6] Prostitution is going strong. With a 20% rate of STDs, this is a huge health hazard. Considering the average age of a female prostitute begining employeement is 14, the current state of affairs is completely failing. 80,000 Americans are arrested annually for sex.

There is no doubt in mind we must act. Remember the average starting age is 14, meaning some of the female prostitutes begin their career at a younger age. By legalizing prostitution we not only reduce crime, thus saving money, but we can monitor the prostitutes for STDs and underage prostitutes. Working conditions would surely be increased.

IV. Conclusions

Freedom, health, and working conditions would be increased and underage prostitution decreased. The only real concern would be human trafficking would be increased. This is because legalizing prostitution would increase demand, and human trafficking, the supply, would increase to meet the demand. Nevertheless, by legalizing prostitution we could have impromptu inspections to crackdown on human trafficking of sex slaves.

Remember, plenty of otherwise legitimate businesses like hair salons and clothes manufacturers use human trafficking slaves. Therefore, the same argument could be made for hair salons and clothes. If we increase the demand for hair salons and clothes, the amount of illegal slaves will increase to meet the demand. Thanks for debating. Legalize prostitution.
