Mental health records should not be kept private because it would prevent those with the condition from obtaining weapons and using them.

Pro

a health record is a collection of clinical information about a patient (http://medical-dictionary.thefreedictionary.com...) mental health records refer to just a persons mental health. The problem is that a persons address and personal details are included in such records, so if the records were public (the alternitive to them being private), then it would be easier for people with malicous intentions to do whatever they want. There are guidelines for the sharing of medical records however the notion they should be public would breach privacy on an alarming scale.

Is it not better, that for the overall safety of the people those records be released? Mental health is observed under rational basis scrutiny and therefore it a law differentiates based on this it must serve a legitimate state interest (saving lives) and must rationally relate to said interest (prevent those who might kill from obtaining the tools to do so).

Are Mental Heath Records not required to be reviewed in order for you to purchase a firearm? Is that not the point of background checks in the first place?
