In looking at the issue of gay marriage and whether or not it should be legalized in the United States, one must look no further than the Declaration of Independence, the document which is considered not only to be the founding document of the United States of America, but whose tenets are revered as sacred political guidelines. Abraham Lincoln invoked the Declaration of Independence in the Gettysburg address when he proclaimed that "All men are created equal," and it was on this very basis that slaves first saw liberation.

In just over two minutes, Lincoln invoked the principles of human equality espoused by the Declaration of Independence and called for true equality to all of its citizens. Sadly, this equality in terms of legal rights has still not been attained in America, because gays do not have the legal rights associated with marriage.

Lincoln called for a unified nation in which states' rights were no longer dominant, and he defined democracy in terms of government of the people, by the people, for the people. Gays should be married for the sole reason that NOT allowing it would be to subjugate them into a role of "the lesser," a person who does not have the same rights as the rest of us. This is unpatriotic and a blatant disregard for the principles of freedom and equality that America was founded on.

I'm not sure where that came from, but no. It couldn't. Marriage existed before the constitution, and the founding fathers made no mention of it within the document. The 10th amendment leaves everything to the states that is not expressly denied to them by the constitution, including marriage. Article 4, section 1 of the constitution also gives "full faith and credit to the public acts, records, and judicial proceedings of every other state", indirectly making marriage licenses legal and leaving them to the states to decide, but insuring that each state recognize licenses issued in other states. That's why there is such an interesting legal debate concerning states that recognize gay marriage, then causing other states to ban it before married gay people move there. The 14th amendment guarantees equal protection under the law, which is why having separate systems for straight and gay people to get married is unconstitutional. But no, marriage itself can, by no means, be made unconstitutional. I have no idea where you got that idea either.

Could it then be argued that marriage itself is unconstitutional?

I agree with you calguy, but for as great a document as the Declaration of Independence is, it has no legal standing. Our laws are based on the Constitution. Now, if you would like to invoke the 14th amendment and court cases such as Brown V. Board of Ed, then you'll have some firm legal footing. :)
