Hi,i challenge you to my debate topic about this.I think we should lowering the age of consent since by rising it only prosecuted innocent teens who willingly to engage sexual relation with each other which doesn't make sense.I would say age of consent should be at 10 or 11 in most places not 16 because on average girls begin already begin with puberty at that age. Once you hit with puberty you should have a freedom choice who you want to be in relationship with.
I accept your challenge. I will be arguing that the current age of consent, in combination with current Romeo and Juliet laws are important for protecting vulnerable youth. Due to the lack of experience which many people below the age of 18 have, it is best that the government sets boundaries limiting who a minor can have sex with.
Firstly, it is an unfortunate fact that the average age of entry into human trafficking is 12-14 years old. This shows that there is a very real threat from people who are willing to take advantage of children for personal profit. With age of consent laws in place, the act of having sex with a minor becomes illegal, helping law enforcement identify and prosecute those who may be enslaving youth.
In addition, Romeo and Juliet laws make sure that those in consensual relationships are not affected. The laws allow for couples who have been dating previously to continue dating so long as their ages are within a certain number of years. This prevents legitimate couples from facing prosecution.
While by lowering age of consent does not make human trafficking,sex trades with child,child pornography be legal.All these sexual exploitation crime will remain illegal while we lowering age of consent.Also lowering age of consent would be benefical in a way that reducing teen pregnancy and STD's infection .At least ,In my opinion we should allow consensual sex between minor because it's just unfair to put them into sex offender registry for just they cause no real harm to others just because one person is over age of consent while the second partner is under.
It is true that lowering the age of consent will not legalize human trafficking, however it will make it easier for traffickers to continue their trade. For one thing, children below the age of 18 are almost always economically unstable. They also often lack the experience needed to identify dangerous situations and the stature to physically defend themselves. For these reasons they are prime targets for human traffickers. With age of consent laws, a trafficker above the age of 18 will immediately be under suspicion if it is found out that they had sex with their victim and they will receive harsher punishments. Therefore the benefits of a high age of consent outweigh the limitations by assisting in the police's ability to recognize abusive relationships. Ultimately the age of consent exists to make the targeting of vulnerable youth by traffickers a riskier endeavor.
The age of consent also encourages relationships between people who are in similar conditions. Almost everyone between puberty and the age of 18 is in Middle and High school. This means that all minors will only be having sex with those who are in similar economic and educational conditions, making it more difficult for coercion to be used.
Lastly the Romeo and Juliet laws make sure that those in legitimate relationships are not classified as sex offenders when one of them turns 18. So long as they are within a certain number of years of each other, their relationship will be legal.
Well but there are certain ways on how we can protect youth from human trafficker.Generally children aren't always the only target,adult and elderly can be the victim of human trafficking as well.First of all,if you want protect your child from abduction,you shouldn't allow them to be in contact with stranger or someone who you don't know them well enough(which often occur through internet access),because predators are more likely to target someone who is naive and easily to manipulated.Also i would agree with you,while we lowering age of consent there should be an age difference.A minor should not have sex with a person who is much older and have life experience than them,in order to protect young person abuse by an adult.But sex between consensual sex minor who is close in age,there is no abuse or manipulation providing than both are not being force.So there should be an age difference.
Just because adults are trafficked too doesn't mean we can't have laws made specifically to protect young people from traffickers. Also it is true that a great deal of the responsibility lies on the parents to protect their children, however when parents fail, these laws offer a second line of defense. Many children will run away from home (possible because of abusive parents) or will be kicked out of their home by their parents, or in some cases can't tell their parents about the trafficking because of religious beliefs (you'd be surprised how many parents will hurt their kids for having sex, even if its rape). In fact it is estimated that 56 percent of female prostitutes were youths who ran away. Its these children that age of consent laws aim to protect. As for consensual sex between minors, this is already legal or at least not prosecuted, what age of consent laws prevent is a minor having sex with someone older than the age of consent.
Well, i would argue that close in age exemption does not have in all country and not all state of america has these exemption.Actually the law was meant to protect all age victim from abduction not only children and young person,however there should be a special protection for a minors because these people are especially vulnerable easily to target.By lowering age of consent does not always mean we legalized incest.Incest should stay illegal even it's between two consenting adults,because there are just too many negative outcomes that can cause severe damage to the child range from suffering birth defect to severe emotional harm that cause sexual abuse by parents.So i would not support incest either.
You say that there should be extra protections for young people as they are vulnerable, well that's exactly what the age of consent is. It prevents those with more power from taking advantage of the youth, which a common tool in the human trafficking business. I don't know why you mentioned incest as it is a separate topic with its own rules and regulation.
Well,i just say that incest is one of the most common that damage the child severely.Such as children who are born with first degree relative incest are more likely to suffer from birth defect.Not only that,also incest with a child especially parent-child incest can cause psychological trauma to the child.Therefore age of consent should prohibit parent-child incest and other relationship that person stand in the position authority of the child.Incest is bad.
Incest has its own set of regulations and ultimately fall under the same age of consent guidelines as other relationships, so I don't know why you added it.
For my conclusion I will simply restate my previous arguments. Firstly underage youth are especially vulnerable to threats and coercion especially if they have runaway from their families. Statistics also show that the majority of trafficking victims are underage runaways. With age of consent laws, it is illegal for these victims to even have sex with someone above the age of consent, giving the police a quick way of identifying possible traffickers and johns (those having sex with the prostitutes), along with making the sentence for trafficking youth harsher. For these reasons age of consent laws are important in combating modern slavery.
Additionally current Romeo and Juliet laws prevent those who are already in a relationship from being prosecuted when one of them turns 18 (so long as they are not too far apart age-wise).
For these reasons the age of consent should remain the same.
