Con

Slavery was constitutional in the year 1858. The constitution in 1858 has no amendments and or articles restricting involuntary servitude or slavery. Also the slaves of the year 1858 were born in to slavery and not kidnapped therefore the Amistad Mutiny case is void. Finally Slavery was perfectly legal by law. Slavery was not illegal until 1863 when Lincoln created the Emancipation Proclamation.

Resolution: Slavery was unconstitutional in 1858

My opponent argues that there had been no amendments to the American constitution regarding slavery at this time, but forgets about the existence of other countries and their own constitutions.
