judges and juries faliure to see date rape as being just as bad as stranger rape. this is dangerous and needs to be challenged, not reinforced by introducing a "less serious" level of criminal offense which fits their prejudices. beliefs like "if a women lets a man drive her home, she is asking for sex", "if a man pays for dinner, a women owes him sex" or certain forms of kissing and intimate touching make sex inevitable" are simply wrong-we should work against them, not with them!!

It is true that date rape has less consequences than stranger rape on average. In this argument, I will present why I believe that it is justified.

My opponent claims that judges and juries consider date rape less severe than stranger rape.
I believe that my opponent is right, however there are reasons that lead to this.
First of all, let us define "date rape".
"Date rape is a subset of acquaintance rape. The two phrases are often used interchangeably, but date rape specifically refers to a rape in which there has been some sort of romantic or potentially sexual relationship between the two parties, whereas acquaintance rape also includes rapes in which the victim and perpetrator have been in a non-romantic, non-sexual relationship, for example as co-workers or neighbors."

From this definition, it is clear that date rape is a type of acquaintance rape. However, date rape is used when two people are in a relationship together, unlike acquaintance rape which is merely knowing the person.

Now, we must define rape itself.
"The crime, typically committed by a man, of forcing another person to have sexual intercourse with the offender against their will".

From our definition from Oxford Dictionary, we can see that it does not explicitly state how it is forced.
Rape does not necessarily have to be forced physically. Rape itself is physical, but forcing rape can also be mental due to pressure or being forced to do so by blackmailing, intimidating, etc.
From the definition, we can also see that rape is subjective. The definition states that rape is committed when the offender is having sexual intercourse against their will. For example, a woman may not explicitly state that she does not want to do it, but she might think that way. And if the woman does explicitly state that she does not want to have sexual relations at the moment, the man may playfully force her even though the woman was serious.

Rape is a hard crime to judge because there is no material evidence most of the time, and because of 2 sides of the story.
A judge cannot tell if the woman truly was raped or not unless there is clear evidence that she was. The fact that the woman was on a date makes the judge believe that the rape was less serious because of the examples listed above.
Stranger rape is more likely to be more dangerous because none of the examples above are applicable.
