It's political, yes; but at the same time there is plenty of philosophy that can come into play here. We're debating what is just, whether or not Justice is relative to where you live, and even on what can/could/does quantify the death penalty.

This seems like policy to me. I's not debate over the morality of death penalty, just whether it should be implemented in a certain state.

I think its asking more about whether the DP in the way Texas uses it is just. As comedian Ron White put it, "If you kill someone in Texas, we will kill you back. Thats our policy."

Not exactly, it's a debate on whether or not capital punishment is just or unjust; not upon the implementation of such. Thus it's a debate about justice.

I don't like the way this is worded. At first, I misread it, thinking that they were saying that Capital Punishment is unjust in Texas, like it would be unjust there, but just in other places. But now I see that they are refering to the modern Texas method of Capital Punishment as being unjust.
