The US Constitution was adopted in 1788, establishing a Federation of States. Prior to the adoption of the US constitution, we were a Confederation of States. In 1776 we declared our independence from the British Empire which was a unitary state.
There are 3 types of geopolitical entities.
1.) The Central Political Unit (Central Government)
2.) The Sub-Political Units (Regional Governments)
3.) The Local Political Units (Local Governments)
A Unitary State is when sovereignty belongs solely to the Central Government.
A Federation of states is when the Central Government and Regional Governments share Sovereignty.
A Confederation of states is when sovereignty belongs solely to the Regional Governments.
A Government is any political organization with a Legislative (Governing) Body.
A State is any political organization with an Executive Administration.
Under a Unitary State the Central Government is a State but the Regional Governments are not.
Under a Federation of States both the Central Government and Regional Governments are States.
Under a Confederation of States the Regional Governments are States but the Central Government is not.
Local Political Units can be divided into 2 categories;
1.) Municipal corporations (Self-Governing)
2.) Unincorporated areas (not Self-Governing)
Municipal corporations are incorporated into a state, and derives their authority from the sovereign state which incorporated them.
Corporations (municipal or otherwise) are organizations which are granted a status as a legal person. Legal people hold some of the same rights Natural people (citizens), but not necessarily all the same rights. For example, a Legal person cannot vote like a Natural person, but they do have freedom of speech.
Under the 10th amendment the power to create Corporations (such as Municipalities) are reserved powers of the States.
When the Constitution refers to the "United States" it refers to the Central/Federal Government.
When the Constitution refers to the "Several States" it refers to the Regional Governments collectively
When the Constitution refers to the "States" it refers to the Regional Governments individually
When the Constitution refers to the "People" it refers to both the Citizens and Corporations of the States.
