In a few hours, Prop 8 will be ruled unconstitutional by a federal judge. What do you think will happen when the issue ends up in the United States Supreme Court.

It will be one of, if not the most, significant decisions the Supreme Court has ever made. If Prop 8 is ruled unconstitutional, it will render every state's restrictions on gay marriage unenforceable. I don't know whether the federal Defense of Marriage Act will be affected, but the issue of marriage would be taken completely out of state control.

Of course, the Supreme Court could decline to take the case, which is what will probably happen.

It's a tricky thing, really. As Steelerman pointed out, if the fed rules it unconstitutional, and the Supreme Court agrees, you may have just won a brilliant victory for gay rights, but you've set a very, very clear precedent - one that may arguably exist already, but still - about who has the bigger say in these kinds of matters. The states will not take kindly to it - even the ones supportive of gay marriage. It represents a huge step forward in a much stronger federation.

Whether or not that's a good thing depends on your ideology. But what ruling the judge makes will have a big impact far outside of the legality of gay marriage.

They used the Equal Protection Clause. What dumbasses.
Under Prop 8, both straight and gay men can marry a woman.
Under Prop 8, both straight and gay women can marry a man.
That's equal protection of gays and straights under the laws.

It will be appealed, I'm sure, and hopefully the Supreme Court doesn't have the same idiocy.

This is similar to the bill that passed in the Canadian Parliament back in 2005 which granted legalization to all same-sex marriages in the country, despite what the provinces said. Except, only one province had the ban in place left, and they never fought or cared about it anyways.

I suspect certain states will not be as passive as Alberta.

In California the State Supreme Court ruled that gays could marry in response propostion 8 was propsed and voted on it would've banned gay marriage. Proposition 8 passed and gay marriage was banned so some people sued the state over so it went to federal court where just now a Federal Judge ruled it unconstitutional for a states to have laws that prohibt same sex marriage and since it was a federal judge it is nationwide
