During a debate over the treatment of the mentally ill a small group of us began having a discussion that I think is worth having on its own, should the protection of the innocent be prioritized over the rights or protections of the perpetrators when the two come in to conflict? Should they be given equal consideration? My opinion is the former and I suspect I am safely in the majority on this but if challenged I will discuss it further.

To clarify since that wasn't articulated very well, I believe the protection of the innocent ought to be prioritized over the rights or protections of perpetrators when the two come in to conflict.
