Might Obama use a recess appointment to bypass the Republican-held Senate in appointing a judge to the Supreme Court? It would be sure to draw outrage, and the tactic is rare, but it would swing the balance of the court. Thoughts?

Depends on the president's popularity. 47% is probably too low for such a move.

This is what I expect him to do, appoint some activist judge in his place by doing everything in his means. I remember when he was new to congress he'd hold all these private meetings with Republicans and they'd come out of them, much less partisan. I assume they aere threatened. No tactic is beneath him.

I think it would be better to pick a solid and well respected candidate and let the GOP burn themselves out. Admittedly I don't know who that would be.

It sounds like a fast recess appointment would still face opposition from the senate
