It's a very general question and there are local, state, and federal variants...

Federally, a law should be that in which addresses a need without infringing on individual rights, or specifically, those restrictions upon the federal government. The amendments don't grant the sovereign rights, they limit the federal governments authority and that is a very large distinction.

Almost all laws are to calm the fears in the minds of those who push to write the laws. For instance, MADD ( mothers against drunk drivers ) pushed to get laws passed to get drunk drivers off the road after a mother lost her son in an accident caused by a drunk driver. Her fear was that other mother's could suffer like she did after losing her son.

When a company builds a new product, they use the patent laws to calm their fear that some other company might copy their ideas to build the same product and compete with them.

It's the same reason someone puts up a sign "keep off the grass" after planting new grass. They fear people walking on the new grass and destroying it.

I think Facts should be a good starting point.

Most laws based on facts are actually based on doctored statistics manipulated for profit by contracting firms.

At least it's less sinister, albeit arbitrary when laws are based on fear. And people can feel good about the status quo.
