Are state bans on same-sex marriage unconstitutional?

  • Yes, they are.

    State bans on same-sex marriage are absolutely unconstitutional. Thinking for a moment to the Declaration of Independence where it is stated, "We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness". The bans are obviously going against this. We're all created equal and we're all given the right to be happy..unless you're different. How is that remotely fair? If we are all equal, then we all deserve to be treated as such. Gay couples deserve to have every right a heterosexual couple has.

  • FEMA rights taken away

    Yes of course state bands on same-sex marriage couple are unconstitutional, the laws made came at a time they where needed, and now that the world is changing its view so quickly they're obviously no longer needed. Sure, maybe in the mind of those who are straight and those who are not are different, but different doesn't make them any bit different from any one else. FEMA rights are taken away from these couples, which is a right to have, and if you don't know what this is, it is the right to be able to take care of a sick relative and be off work and not be fired. But for a gay couple they can get fired, this is obviously unfair, and uncostitutional.

    Of course it is, anything that limits a persons freedoms or right to make a decision as an individual is unconstitutional. Granted that decision doesn't hurt anyone else. I just don't get why people want to limit someone else's way of life when they have absolutely nothing to do with it. At some point you just have to shut up and deal with the fact that you don't like something but a great number of the population does. LEAVE PEOPLE ALONE! Its really not that hard.

  • They sure are!

    In Loving v Virginia many years ago, the Supreme Court implied that everyone should have the right to marry. It was seen as a fundamental right. This should apply to all couples, including same-sex relationships. There are a lot of federal benefits to marriage that are currently limited to heterosexual spouses, and that is completely unfair. State bans should be overturned and a federal law should be passed barring any future restrictions on same-sex marriage.
