After all, it is the school's locker. i am doing a debate on this at school and if you look at the statistics, 40 students get shot or killed by fire arms each day. Fourty. i personally would rather have my principal see who i like than get shot by someone because the principal didn't check their locker.

The locker doesnt belong to the student, they have no right to complain that their privacy is being invaded. The only things that should be in that locker are school items and possible electronics, those dont really call for complaint. If theres anything else in the locker that makes the student feel embarrassed it probably shouldnt be in the locker in the first place. Besides, searches keep all students safe and thats all that should matter.

I do not approve of student's lockers being searched without a reason, BUT a public school is a public instituion, administrators should do what is necessary for the safety of other students. And I don't know how other school systems do this but in MY school before getting a locker you sign a warrant that grants the school to search your locker in case they suspect anything such as drugs or weapons etc.. This has never happened at my school but they have the right to and students sign this before getting a locker, so you are already giving them permission. If a school possesses sufficient evidence that a student is using their locker to store contraband then it should have the power to search the locker. If the school doesn't have the power to search lockers then more devious students may use it to their advantage by storing dangerous or illegal items that could undermine safety in the school.

i think we should have lockers because i dont like to carry everything and have all the weight on my shoulders and i think we should have lockers to put our books, papers, and pictures etc. And it helps me so i dont hurt my back because all of the heaviness
Under property laws, faculty of the school have the right to submit students to locker searches; however, they do not have the right to search through a student's personal items, such as their backpack, I believe. A student's family owns that property, but if a student has anything out of the backpack and in the locker, the school has the right to search that.

I understand the whole thing about the safety for the students. If school authorities have a strong enough feel they should be given the right to search the lockers if it is immediate danger. If not it all depends on what the student parent handbook says. If in the handbook it says that teachers have the right then well they have the right. But if it doesn't say that then the school must get legal approval to search the locker if the threat is not of immediate or life threatening danger.
I've had a friend killed in a school shooting. I've also had a friend overdose and the drugs came from his school. Both of these things could have been prevented if the school would have searched the students bags/lockers. I know that my friends were doing bad things (in the drug case) but he could have gotten help if we had known. So yes I think the school should search lockers. It could have saved my friends lives, and it could save yours.
I do not agree that schools should be able to search students lockers without their permission. It states in the 4th amendment that "the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized." I also think that the only reason the school should search one's locker is if they have shown suspicious behavior. Students should not be considered suspects unless the teacher has legitimate proof.
the schools do not have the right to search our lockers they are rented out to the students but if the student is of suspicion then yes they do but what is the student does not have anything illegal but just plain embarrassing and it could be costly because the students parents might sue or press charges and then the schools would have to pay more for and administrator to search the lockers and its a waste of time.
Why should they get to look through our stuff? We Don't get to look through their stuff. If there is no proof that we're doing anything wrong they shouldn't get to look through our stuff. Students aren't told to sign anything consenting to locker searching. If given something to sign then maybe. When administrators say they have probable cause they really mean we don't trust you and we think you would be a druggie or a thug with a knife. I disagree because its the parents responsibility to check their child's back packs for weapons or drugs, not the school to check your locker. I had the personal experience of being stood up at a locker search and seeing someone else's lock on my locker. Despite my protests, it was opened and I spent a month in detention for the porno magazines someone else left in my locker. Thank god it wasn't drugs or guns they left. Even with locks on, these lockers are often not secure.

I am a high school student and recently a student who was accused doing drugs had his locker searched by the dean without him knowing. This is a misuse of authority because students are conscious, thinking people and they should have protection from their third amendment rights just like any other adult. Lockers are students' personal space just as a house is for an adult. The student that got his locker searched got a lot of days of detention which is unlawful because of the third amendment. When these searches are being conducted they will most likely do anything to find what they are looking for. If they do this then some of your belongings will be damaged and/or broken. Some of those belongings may not be replaceable and if they are replaceable it may be a very expensive and you will probably have to save up a lot of money to replace it. When I was in school I was taken out of class a paraded down to my locker to open it so that a search could be conducted. The basis of this search was that they smelled pot. If in these searches they find one knife, or one packet of drugs, how many student's privacy would have been invaded? Schools need a warrant to inspect a student locker. The Fourth Amendment doesn't apply to just one person or a group of people. It applies to ALL people. INCLUDING STUDENTS. The locker belongs to the school, but the belongings inside it belongs to the student.
1) Its a violation of your personal things and/or self. Even if I did not have anything to hide, I would NOT feel comfortable getting searched. Me and/or my stuff will have been violated!
2) It is against the law to search one or ones things without reasonable suspicion. So technically you need a permit first before searching.
3) You'd still not be making the school and anyone safe. Simple, just because one does not obtain a gun/knife/illegal substance one day, surely does not mean the next day they should of brought one, and surely it is not a very civil thing to check ones backpack daily. That is just absurd!

It is the student's property after they pay for it. They keep their personal belongings in there such as their phones, money, etc. However if they have a really good reason to believe that student has done a crime or has possibly been seen with a inappropriate things at school they should be granted the permission. When I was in high school the counselor and police pulled me out of class during a test. All the students in class looked at me as if I were a criminal, and many students from other classes to as I was being escorted to my locker only to open it for them to find nothing they were looking for. I had to stay after school to complete the test and got home late (I lived more than an hour away) and had no time to study or do homework for the next set of classes I had to attend the following day.

There should not be conditions placed upon something that is illegal that makes it okay in certain circumstances. People believe it makes them safer, an example being that the student was carrying a gun. The schools are not prevented from using metal detectors. Teachers, principals, anybody who works for the school, cannot because if someone works for the government (teachers work for the government) they cannot search personal property without a warrant. I know the whole thing has been through the legislature and they have permission to search your locker because your locker is part of school property, but your backpack has been bought by your parents and that is part of your property. They can search your locker but not your backpack.
