Do schools have the right to search students' lockers?
Not only should all lockers be searched, but all student's bags.
And, mandatory drug testing of all students at least quarterly using hair samples, which can't be beat. If the hair is tested, all the illegal drug users would be caught and put into therapy. Second offenders would be kicked out until they test negative for 6 months.
The good students need a break from the drug and gang punks that are destroying our high schools and grade school.
After all, it is the school's locker. i am doing a debate on this at school and if you look at the statistics, 40 students get shot or killed by fire arms each day. Fourty. i personally would rather have my principal see who i like than get shot by someone because the principal didn't check their locker.
If there is ONE truth, it's that students keep drugs in their lockers. School is a great place to deal drugs... It only makes sense that if the school suspects somethings up, they should check. We need to remember that your locket isn't a private area... It's publicly owned. The school owns it, not you. The only reasons you'd be against the school checking your locker is if you had something to hide. Books, a calculator, some pencils... You shouldn't care if the school looks in and sees these things. When my taxes pay for the lockers, they better be used for legal things.
100,000 students bring guns to schools and 260 teachers are physically assaulted every day in America. Often parents are unaware of their children doing it. We could reduce these numbers by having school administrators conduct locker searches, it is valid in cases of reasonable suspicion of possession of weapons and the school has prior rights to lockers since those are part of the school's property and were only lent to students.
When a student goes to school and is assigned a locker, the space is not bought or given to them and there is no contract implied by it's use. While they are free to use, or not use, it as they please they do not have explicit owner ship of the space. So, the searching of said space is at the discretion of the owner. That being the school.
Some students have been arrested for being in the possession of illegal drugs, chemicals, knifes, and dangerous firearms. The National Education Association estimates that 100,000 students bring firearms to school every day and forty of those students are harmed because of it. The benefit of these searches, discourage other students from bringing illegal or dangerous objects to a safe environment. Locker checks will make more students obey school policies in the future and will reduce the risk of school shootings and other dangers. Students will not know when these searches will be therefore they will not bring anything hazardous to school. Teachers may take precautions if they feel that a student may be in the possession of a weapon.
The locker doesnt belong to the student, they have no right to complain that their privacy is being invaded. The only things that should be in that locker are school items and possible electronics, those dont really call for complaint. If theres anything else in the locker that makes the student feel embarrassed it probably shouldnt be in the locker in the first place. Besides, searches keep all students safe and thats all that should matter.
If someone came to your house and stuffed their jacket in your closet, but the jacket smelled like weed, wouldn't you to have the right to examine it? After all, it is your house, and therefore, your rules. It is rude, and therefore shouldn't be used unless there is an emergency. The same applies to schools and their locker searches. They're just protecting their property. There's nothing wrong in that.
Like it or not. Student lockers are a temporary use for students to use. It not technically theirs, but the schools. Therefore, the school has the ability to search with probable reason.
I believe that schools should be granted the permission to search the students' lockers to a certain extent. They will keep other kids safe from drugs and weapons. The other reason is to stop all of the drug dealing that is going on in schools all around the world. Children think that just because the teachers don't catch them right away they believe that they will not get into trouble. School is one of the best places for students to sneak in drugs and weapons. People have different opinions on locker searches and personal searches. In my opinion I think that they should be allowed in several schools all around the world to protect the school and all of the children in these schools.
The school allows students to use lockers that they own and paid for on the premise. It is a privilege, not a right. A student shouldn't put anything in a locker he or she would not want school officials to see anyway, and it literally comes down to there's nothing to worry about if you have nothing to hide. All that are in lockers are books, bags, and coats. If there's anything else a student feels offended that they see, they shouldn't put it in a locker.
I think if there is a reasonable amount of suspicious behavior exhibited by a child at school, the authorities there should be able to search their locker. School children shouldn't be immune to the laws of search and seizure because they are underage. Unfortunately, these days, we all have to be vigilant everywhere. If a kid has something in their locker that could cause harm to himself or to others and there is just cause to open the locker and take a look, then that is what should happen.
Lockers are essential for the student body, but also provide negative possibilities for students as well. For a student whose locker is safe and free from anything harmful or suspicious, a locker check would be fine. Lockers are only needed for books, sports bags, and other things like extra clothing.
yes they should, it is not like we have guns or bombs or drugs in their. we might have a picture of a guy or girl but who doesn't have that. and when we open our locker, our peers can see whats inside, so that doesn't make your stuff private anymore.
Schools do have the right to search lockers. A locker is not owned by any student, it is property of school to which the school allows a student to use. It would be like allowing a friend to borrow your car and then searching it after he has used it. A search of a locker does not violate any person's privacy because the person does not even own it, the school does.
The school owns the lockers not the students. If you are worried that they will search your locker than you most likely have something to hide. You can always take stuff out of your lockcers and bring with you if you don't want them looking at it. Don't put stuff in your lockers that you don't want to be seen, cause most likely someone goes into your or another persons locker without you knowing.
As a student, I have heard of the shootings that have occurred at school. I am willing to submit to locker searches in order to prevent the possibility of weapons or illegal substances being brought to school. I want schools to be safe and if it is possible for students to hide things there, it will never be possible.
Schools should have the right to search students' lockers because some students may bring guns, drugs or other potentially harmful things to school. If school officials check the lockers, students will be safer. Every day there are students getting hurt by other students. It is a simple matter of saving innocent students from harm.
Lockers are school property. The school is responsible for the safety and care of all students. If there is reason to believe that a student may have something illegal or harmful in their locker it is the schools legal and moral responsibility to search. When parents enroll there child in a school they are giving that school the responsibility and the duty to care for them. Not allowing a school to search a locker would be like not allowing a parent to search a bedroom. Don't get me wrong...I do believe children have certain rights but when it comes to there safety or the safety of others privacy is not one of them.
I am sorry to say that in today's world it is necessary to sometimes search locker's in schools today for the safety of students and teacher's. There have been to many cases of students bringing weapon's to school and using them to hurt and even kill other students and teachers. So yes the locker is only given to the student to use while in school and it does belong to the school so yes they can search it if they need too.
The locker searches are only conducted if there is suspicion and a search dog to lead them to the locker. Why would students go against locker searches if they had nothing to hide? The lockers are private and are not being opened and searched publically. The lockers are also part of school property and are a privilege to students that can be taken away. Students should not bring things into the school and put them in their lockers if the items are not supposed to be at school in the first place.
I do not approve of student's lockers being searched without a reason, BUT a public school is a public instituion, administrators should do what is necessary for the safety of other students. And I don't know how other school systems do this but in MY school before getting a locker you sign a warrant that grants the school to search your locker in case they suspect anything such as drugs or weapons etc.. This has never happened at my school but they have the right to and students sign this before getting a locker, so you are already giving them permission. If you have something to worry and dont want to get your locker searched if you are suspectd of carrying a weapon you can just simply not get a locker, you always have that option.
They should have the right because once you go into a school you have entered public property and you rent a locker from the school. Therefore, they can search what you bring in. To break it down, If you don't have anything to hide, why do you care if they search your stuff?
According to the case New Jersey v. T.L.O. (1985), "Your Belongings Can Be Searched, But Not Arbitrarily." Im a fellow student of a school but support the search as long as there is a reasonable cause for the search. This means that the school can search THEIR locker as long as they have a reasonable cause, if you didn't read it the first time. Even though that we believe it to be ours, it's not. They lend it, we use it. We dont actually pay for it and take it home.
I think this is a good thing because if a kid is holding drugs or something bad in their locker they can get busted. They can also be arrested for what they have done. If they want to make that decision they can choose to do so. That is why I think schools should be able to check lockers.
Searching a student's locker is not a violation of privacy because the locker is the property of the school. Students do not have an expectation of privacy in regards to a locker. It belongs to the school and the school can use it as they wish. Since it is the property of the school; they can search it whenever they wish. The student has no rights regarding lockers or anything else that is on the school's property.
The school has the right to see what's in our lockers because they own it. They provide it for students to use throughout the school year and it doesn't mean that the student could have it forever. They should only allow those people who work inside the school to search lockers, not the other students.
We might keep out stuff in our lockers, but they belong to the school. We shouldnt be keeping anything in them that would be harmfull anyways. im 15 and would let anbody serch my locker if needed.
If someone is accused of something by the police and they have a locker at school, it is absolutely necessary to have a search for the sake of student safety in school. Kids are supposed to be there to learn and be safe. If there is no reasonable cause to search, then its a different story.
Schools have rights to search lockers because its there lockers they bought it and when your parents sign a piece of paper that says that the school has all permission to search and find weapons or harmful things.
If drugs were took in the school the person will be charged and will be asked to leave the school.
This is a debate about privacy, and the extent to which the state can invade the private life of its citizens. Although it may seem unimportant, the school locker is usually the only private space available to a student in the communal environment of the school, and so it focuses many of the issues involved in privacy debates.
A locker is the schools property. They are provided for the student's convenience. However, students also keep private things in their locker that they dont always want the rest of the world to see. The administration cant just go sticking their noses in students business whenever they feel like it. They have to have a good reason and they have to tell the student their reason before they go through the students belongings. The police cant come into your home unless they have a search warrant and its the same situation here.
Yes schools do have the right to search students locker, because if a student is involved in sports or other extra curricular activates the school needs to be sure that the students that are in those activities are following the rules, that everyone else has to follow. Also if anyone has a feeling of fear that they might be hiding something then the school should have the right to search that persons locker. Also I feel that even if they don't have anything against, and they just want to do a random locker search they should be aloud to, because we are at school and its their job to keep the students safe. Yes schools should be able to search anyone's locker.
Student's lockers are not personal or private property. The constitution protects us from unreasonable search and seizure of PRIVATE PROPERTY. The school owns the locker and surrounding area. On the other hand, I don't think a random search of backpacks would be reasonable. Backpacks are private property owned by the student. With probable cause, a backpack should become search able, to protect the rights to life, liberty, and the pursuit of happiness for the other students.
If someone is keeping fireworks or a gun or a bomb in their locker than the school should have every right to search for it and protect students from potentially dying.
We believe that schools should be able to hold random locker checks because there have been many deaths and harsh bullying of all types due to the items that students bring to school and hide in their lockers. Another reason is because lockers are a part of school property and "all things that students bring should be suitable for searches". Lastly, students may bring illegal drugs and the school would be held accountable for the students behavior.
Simple argument, schools need to become a better environment for the student. By including frequent, randomized, locker searches, the student body will overall become a better environment for nurturing the pupil's mind. What the students do on their own time after school is out of our control and it is their own business, but the board of education needs to make the school a focused learning environment for kids.
Seeing as lockers are technically part of school property, they can retain the right to search them. That said, I think it is terrible for student morale, and should only be implemented for very compelling reasons. If the student poses a threat to him/herself or others, then a locker search is warranted.
Kids all around the country feel threatened by others bringing potentially harmful substances or weapons into school every day. I personally know a bunch of kids that have drugs or weapons in their lockers daily and take them out when they hear of a locker search in the near future
In order to protect the minority, schools may need to embarrass or
even infringe upon the rights of the minority. There is too much violence
in school, far too many drugs and I do not want my child running
around in an environment that ties the hands of the people who would
be trying to protect her. It is a small sacrifice to search private property.
random searching of school lockers and cars on school prperty can keep us all safe from the crazy people who want to bring knifes and other weappons on to schools grounds and the use of drug dogs can keep some stupid person from bringing a illegal narcotic on to school property and giveing it to another student causeing tem to have a allergic reaction and possibly die
Schools should have the ability to search student's lockers to help ensure the safety of all the students at that school. School's should use discretion and not go overboard with it (i.e. having a random search of every student's locker once a month would be way too much) but ultimately if there is a threat of a possible weapon or possible drugs in a student's locker the schools should be able to verify this.
Lockers should be checked because there could be drugs, alcohol, and weapons in their lockers. Bringing all of this stuff is highly illegal and against the rules of schools. It can kill you and you can kill others. If students' lockers were checked it would reduce the gun killing and selling of drugs. If you find drugs in their locker and they say they have never touched drugs you can take a hair sample. A piece of hair cannot be cleaned. Students' lockers should be checked without the students knowing what day. Without the students knowing what day they will never know when to take the drugs, guns, alcohol out of the locker. Keeping drugs, alcohol, and guns in your locker is not a good idea because if you tell anyone they can break into your locker and take it. They can go and sell it or shoot someone and say it was you who gave it to them. Using drugs or alcohol can make you do stuff you did not mean to do. Having guns can influence you to kill or store it in places you are not allowed to have it like school. Not only should the students' lockers be searched but their bags also. Searching bags will make a big difference because then they cannot hide it almost anywhere else
The student is there at the school to learn, and if there is something in the student's locker stopping the process of learning then administration can go through the student's locker. however the schools should provide more security from other students.
Schools have an obligation not only to teach our kids, but to also keep them safe. The more proactive schools are, the less incidents there will be, and children will learn that they cannot get away with things. Tragedies can be avoided. If the school turns a blind eye, then I think they should, and more than likely will, be held accountable.
A locker is the schools property, if they want to search it because they are suspicious then that is there choice. People shouldn't have anything bad in there locker, you should not have nothing in your locker but your school items. A locker is no different than anything else the school lets you borrow, so therefore they should be able to search your locker.
History can teach us a lot of important lessons. One of these is that schools must be able to search lockers, put in metal detectors, etc. It is simply a matter of the safety of the students and faculty. Columbine and Virginia Tech. are prime examples of why this right remains with schools.
yes they should because some students may have beer or smocking packets or an BB gun or have inapporite pictures in there like the door or the wall and the pictures could be of girls or blood or a knife could be in their locker and a bow and arrow
You cannot by any means invade a persons privacy. You might as well search the teachers and staff as well because I can point out many teachers who have definitely been under the influence of something during the school days -- almost every student can. Unless a student is under suspicion or it's proves that he has done something wrong, then It is truly not needed.
Students are given these lockers, they do not purchase them nor were they born with them. Therefore they are not they're lockers. Yes you store your things in them but if you are storing things such as weapons or drugs then you should be punished. Think about being in your own car with someone beside you smoke marijuana. Then you get pulled over and the cops search your car and the marijuana is found. You are responsible because the car is in your name. You friend may not even have to go to jail. It is the same with school lockers. If you store something in them the school may get in trouble for it too. Think about it.
School is a place that students should be able to go to and feel safe. Students and their parents should not have to worry about them being at school worrying about drugs, weapons and violence. School shootings is very scary to think about and nobody wants that to happen. It is the schools property so they have the right to search whatever they please. Would you want your kids going to school with other students having drugs and weapons?
School lockers are not the property of the students; students rent them from the school. Since the lockers are the property of the schools, schools should have every right to conduct arbitrary searches on students' lockers whenever they feel it is necessary to protect the school environment and promote the advancement of education. Schools are a place of education first and foremost and any activity to the contrary is subject to school policy and regulations.
I believe that schools should be granted the permission to search the students' lockers to a certain extent. This will keep other kids safe from drugs and weapons. The other reason is to stop all of the drug dealing that is going on in schools all around the world. Children think that just because the teachers don't catch them right away that they will not get into trouble. School is one of the best places for students to sneak in drugs and weapons. In my opinion searches should be allowed in several schools all around the world to protect the school and all of the children in these schools.
It keeps schools safe and drug free. Kids can go in schools with drugs and bombs. The bombs can detonate during class causing deaths and injures. Drugs can be caught and be tracked to people, which would let them get a taste of jail which might reduce crime. The world would become better and help the world.
I think that the should be able to search students' lockers because the locker is a part of school property ,so the school technically owns the locker. So, they should be able to look in when they want to. Also, the student may be carrying drugs or alcohol and breaking the law and no one would know or be able to put a stop to it because they never looked inside their locker.
School is held with the responsibly to keep you and every one in it safe. Your own life can be put at risk, you may not have anything to hide but someone else may. Keeping your self safe comes with the price of a little less privacy. and why should that matter? You have nothing to hide remember?
Schools should have the right to search a student's locker if there is good reason to suspect that a violent crime is immanent and could be prevented by such a search. I do not believe the school has the right to search a student's private property for any other reason, and certainly not without probable cause to do so.
A school is responsible for the safety of the children who attend. In extreme circumstances, it may be important to the students' safety to search lockers. The school should have the right to do this while still maintaining discretion for privacy and confidentiality.
You do not buy that lockers that are provided to you at the beginning of the school year. It is for putting book and educationaly things in it so that you can keep your BOOKS safe. When the principal allows a police to have locker searches, it is under the principals control wether or not you can get your locker search or not because the lockers are school property, so it is only fair that that do locker searches for both the safety of the school, and the safety of the students and the enviroment they are in around them
students do not owne the lockers. if thay have anything in there thay should'nt thay should get in more truble than if thay had sumthing in there owne car. The lockeres relly are state property.
Yes, because it's the school. If you don't want the school to see what's in your locker, then just keep it at home or don't put it in there. There is no reason the school shouldn't be able to search your locker. It's better to have your locker searched than to be unsafe.
Staff and faculty of schools who allow students to use lockers (which are school property) reserve the right to search them, owing to the fact that a student doesn't technically own the locker. Most students believe that a locker search is an invasion of privacy, and I can relate. However, students should bear in mind what they put into their lockers. Don't put anything in a locker that shouldn't be there, such as contraband items and other personal belongings that aren't allowed.
They paid for the lockers and they are responsible for students safety. They need to make sure that the students are doing the right thing and not have illegal substances that will be dangerous to students fellow peers.
They paid for the lockers and they are responsible for students safety. They need to make sure that the students are doing the right thing and not have illegal substances that will be dangerous to students fellow peers.
Would you rather be in danger of weapons, have your property stolen, or be in a school with people doing drugs which could lead to dangerous actions? OR would you prefer to have school authorities search lockers for the protection of students? I would rather have locker searches than be surrounded by dangers throughout school. What's so bad about having locker searches if you don't have anything bad in it, unless you do, which is why you don't want them to occur.
There have been many problems in schools with drugs, smoking, theft and weapons. The power to search lockers would help schools to eliminate these problems from this highly vulnerable age group.
They have all rights to search a students locker. The locker is given to the student for the school year. The school owns the locker, giving them all rights to search a locker. I know that its invading space, but the school needs to protect the school and the students.
I think that we should have them everywhere because there is a lot of kids that have the right to use guns and they know the password to the safe that the weapon is in. I also say that because of all the different drugs going around and how easy that you can get them so if we have locker checks then all schools would and will be safer.
Schools search lockers for safety reasons. They want to make sure the school is safe for the students and staff. This isn't a matter of privacy. The lockers belong to the school and if you have nothing to hide, then what is the problem? They won't be taking your personal belongings unless they are a danger or threat to the school. It also is not a matter of trust. Every person's locker should be searched just to be safe. There has been cases in my school where someone unwittingly had drugs stashed in their locker because a friend or significant other hid it there without telling them. Once again, the schools would do this to everyone for the safety of all; they are not personally attacking or accusing you by checking your locker.
Students are at school to learn, and since schools are a communal environment providing a service, students personal rights are superseded by the safety of the student body. Also, school lockers are property of the school it is in. School administration has an obligation to search lockers of students suspected of harboring dangerous items such as guns or drugs. Students should be made aware that school lockers are the property of the school and are subject to search without notice.
I'm 99% sure that your locker dosn't belong to you. A locker is the property of the school, so they have the right to check it as they please. If you brought your own locker from home, then they can't check it. If your locker was assigned to you by a school official, they can check it as they please.
Kids these days just don't know what drugs can do to you i mean if you had a locker neighbor that had some kind of drug in there locker would you tell for your own safety and there's? And people on the right side of this page i respect your opinion but would you rather be 100% sure that you where safe from a possible shooting of some sort and not have the respect or what ever that you want or have your respect and possibly get killed.
If a school possesses sufficient evidence that a student is using their locker to store contraband then it should have the power to search the locker. If the school doesn't have the power to search lockers then more devious students may use it to their advantage by storing dangerous or illegal items that could undermine safety in the school.
the teachers should check their lockers because they might have drugs that they sell or might have a weapon that can hurt, harm or kill someone.Say like a boy brings a knife to school to kill someone and a teacher found it.He should get suspended or go to jail for bringing a weapon to school.
i personally think that schools should be allowed to search their student's lockers just to be safe.Students can store contraband, lockers can also make it easier for bullies to get to their victims.I rather my school see my pads or tampons (period kit) than having someone that has a locker next to me and has a freaking gun or knife in it!
Should students lockers be checked?
64% of the Americans say yes. Lockers should be checked because their could be drugs, alcohol, and weapons in their lockers. Bringing all of this stuff is highly algal and against the rules of schools. It can kill you and you can kill others. If students lockers were checked it would reduce the gun killing and selling of drugs. Students lockers should be checked without the students knowing what day. Without the students knowing what day they will never know when to take the drugs, guns, or alcohol out of the locker. Keeping drugs, alcohol, and guns in your locker is not a good idea because if you tell anyone they can brake into your locker and take it. They can go and sell it or shoot someone and say that you are the one who gave them it. Using drugs or alcohol can make you do stuff you did not mean to do. Having guns can influence you to shoot it more often and want to kill stuff. Lockers can be checked by the schools because it is school property. If the student is in a sport or extra curricular activity the school should be able to search the locker so that they can know what kind of stuff their doing. Every year their is less drugs, and alcohol in schools because of locker searches. Their is also less school shootings going on after schools are searching the students lockers. If your family has a history of drugs or alcohol it can lead to you doing them because you see someone else drinking and you think that it is ok to do it. Searching for drugs or alcohol can make the school a better place to be. By searching lockers it will put criminals in to jail and get kids expelled or suspended. Having school locker searches will not only allow the school to be safe but the state too. It will tell kids not to buy drugs and it will tell them to call the police if they know someone who does drugs or drinks alcohol. The lockers do not belong to the students, so the student should not be able to put anything they want in their lockers. If their is a kid and he does drugs it will influence other kids to do it because they think that it is cool. So yes I think searching for drugs and alcohol should be aloud for the safety of students
the school ie in responsible for the students and yeacher's safety. I know if my mama r god mothe rget hurt on there jod my dad an godfather ars going to sue the child and the school so they should have the right to do what ever they need to do to keep the & teachers sefe.
i think we should have lockers because i dont like to carry everything and have all the weight on my shoulders and i think we should have lockers to put our books, papers, and pictures etc. And it helps me so i dont hurt my back because all of the heaviness
Under property laws, faculty of the school have the right to submit students to locker searches; however, they do not have the right to search through a student's personal items, such as their backpack, I believe. A student's family owns that property, but if a student has anything out of the backpack and in the locker, the school has the right to search that.
I think that it is absolutely okay for either the police or the school administrators to do locker searches of students as long as there is a reasonable cause for it. The purpose of these locker searches is for the safety of the students anyways. There is honestly nothing to worry about if you don't have anything that shouldn't be there such as drugs or weapons. So does the school have the RIGHT to do them? It clearly says that searches are legal as long as they don't destroy anything. So locker search should definitely be done for the safety of the majority!
Students are given the privilege of using lockers provided by the school to store books, assignments, sports equipment and other items they do not need to carry to every class. It is a convenience, not a private storage facility. Provided this is made clear to students there should be no issue when it comes to privacy. They always have the right not to use a locker if they wish.
Personally I think that schools should search lockers. Students should feel safe at school, one way to make that happen is to be able to search lockers. There may be people saying that they are not respecting their privacy. But in all respect, they could be hiding something. In school I don't want to have to worry that I won't make it back home, because of some student that brought a weapon to school. Think about it.
I understand the whole thing about the safety for the students. If school authorities have a strong enough feel they should be given the right to search the lockers if it is immediate danger. If not it all depends on what the student parent handbook says. If in the handbook it says that teachers have the right then well they have the right. But if it doesn't say that then the school must get legal approval to search the locker if the threat is not of immediate or life threatening danger.
I've had a friend killed in a school shooting. I've also had a friend overdose and the drugs came from his school. Both of these things could have been prevented if the school would have searched the students bags/lockers. I know that my friends were doing bad things (in the drug case) but he could have gotten help if we had known. So yes I think the school should search lockers. It could have saved my friends lives, and it could save yours.
I do not agree that schools should be able to search students lockers without their permission. It states in the 4th amendment that "the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized." I also think that the only reason the school should search one's locker is if they have shown suspicious behavior. Students should not be considered suspects unless the teacher has legitimate proof.
the schools do not have the right to search our lockers they are rented out to the students but if the student is of suspicion then yes they do but what is the student does not have anything illegal but just plain embarrassing and it could be costly because the students parents might sue or press charges and then the schools would have to pay more for and administrator to search the lockers and its a waste of time.
Why should they get to look through our stuff? We Don't get to look through their stuff. If there is no proof that we're doing anything wrong they shouldn't get to look through our stuff. Just like when cops break in to houses; schools should have to have a warnt. And if they don't when they break into our lockers ,that we are renting for the year, or when they search through our bookbags, that is our property, they should get wrote up or something they shouldn't just get away with it.
Clearly it does not protcet us childern from the illeagl search and seizure. Apound a search and seizure if anything it to be found why isnt it trund back over to the parent. Schools personal should not have the right on a supstion of smell or on the way the student walks or talks even how they star at the teacher. Us students need to stand up for our right to the 4th amendment.
I think that their should be no locker seaches because kids have to have their own privacy.some students carry special things from a loved one who had died that was given to them and they hang on to it because it is special to them.
Do you teachers want to do that to a poor little child and make them miserable every second because you took that one special thing that he had in his book bag or locker.so just think about that for a second.
Students aren't told to sign anything consenting to locker searching. If given something to sign then maybe. When administrators say they have probable cause they really mean we don't trust you and we think you would be a druggie or a thug with a knife. Kids in my school, with perfect grades, have gotten searched and had phones and iPods broken from falling out and being stepped on. Zero accountability.
What is the point? I am only a 5th grader. Why do they give us lockers if they are not going to trust us? They can mess up our stuff if they do. I think it is just a waste of time for them to search lockers, because we are only 5th graders.
A college would never do this. We should be more careful about students rights before college because they have no choice about being there. Being harsher and stricter on them is taking advantage of them and their lack of choice in the matter. For all practical purposes the child is thrust into an environment where they must use the locker hence the locker should be considered their private, personal space, although not off limits to the eyes of their parents should the parents have a reason to suspect.
It is unfair to students and the good students because the good students waste class time to check lockers. If adults can check students' PERSONAL BELONGINGS then students should be able to check the adults' personal belongings. But no, have you ever gone through a teacher's desk? No, because the school trusts them and the school should trust its students too!
Student locker does not need searcH because of privacy and teacher just need to trust students and that also teachers need to learn that all kids are not bad kids and they really need to start trusting kids and not thinking hay can't trust this kids because the way they
Schools shouldn't search students lockers, course that is not good for kid morale and in case student wants to bring illegal thing he can do that without locker. As it was said kids are people to. Think yourself would you like to that anybody who wants can come into your house and check things?
Locker searching should not be allowed because even if it is not the students property the teachers do not have a right to search their locker. It's one thing for a cop to come up to your home and force you to let them search your house but its another for teachers to search your locker for drugs and weapons. I don't think it should be legal and therefore I make my statement that locker searching should be illegal!
there can be stuff like lunch the are trying not to lose or be taken by someone. But if the student looks very suspicion then yes they will have to search lockers. But students might need just somethings private. But if the parent/guardian needs to sue the school or put charges on the school then they have a good reason. So then the school will have to pay a lot and the administrator will have to come in and search threw the lockers. An each minute they are searching the locker then they are wasting time!
Well the first thing is, they're looking at your personal things, and maybe just maybe, people like to have some privacy. Yes, people might have drugs, guns and more, but i'm sure people will report those type of things. Plus students should have more rights for what they believe in.
We shouldn't have the right to search students lockers. They may want to keep personal stuff hidden because they could have some really embarrassing stuff that is very personal to them, and the person searching could steal stuff from that student, and they could have some rare stuff in their locker.
i think that is stupid that schools go throw students lcoker. they have no right to do that anyway bcz it is stupid.
no no no no! i have things in my locker that i would like to be kept private. And no its not illegal its my own private stuff. I know that the school owns the lockers but for the short time that im at school i would like to keep my private stuff in there
I actually don't ever use my locker... But if someone were to look in it... What if one day I actually did use it... If I brought my laptop to school (because I have school work on it) and put it in my locker because I don't want someone taking it? Then my locker gets searched and they take it? Then I can't do my work.
I think no because unless they have a reason, then I don't think that schools should check students' lockers. Like if it's guns or drugs or alcohol or something serious like that, then it's necessary to check a student's locker, but other then that, then no, just flat out no.
I believe in personal space, and it's not the school's property to be going through and dumping everything out of student's lockers and backpacks! It could be something that could make kids embarrassed or very stressed out about. It could also make parents worry about things getting taken. It can also be a safety problem.
No I do not agree that schools should be able to search students lockers without their permission.
I disagree because its the parents responsibility to check their child's back packs for weapons or drugs, not the school to check your locker. There also may be private stuff in your locker that you don't want anyone to see. If you don't want them to have privacy then don't give them lockers. Lockers give kids a little sense of freedom in school so why take it away?
I agree because it reduces violence in school and it keeps others safe also its the school's property so they are allowed to search the students lockers.
I had the personal experience of being stood up at a locker search and seeing someone else's lock on my locker. Despite my protests, it was opened and I spent a month in detention for the porno magazines someone else left in my locker. Thank god it wasn't drugs or guns they left. Even with locks on, these lockers are often not secure.
It's very understandable if you think there is a drug, gun, or any weapon, but you are not allowed to go through teachers' stuff, then they can't go through yours. They say too bad, you can't do that, that is my personal stuff. Well, same with the lockers, and MY backpack or MY locker, they say it will be YOUR locker, so.
I disagree because students should have our privacy. Schools already do drug tests so they don't have to worry about the use of drugs in their school. Also students may leave personal stuff in their lockers that is private and they don't want anyone to see it. Also the schools give their students lockers to keep their stuff in and for privacy if you don't want them to have private lockers then use classrooms to keep their stuff instead of going in their lockers. That is why I disagree with random locker searches.
I am a high school student and recently a student who was accused doing drugs had his locker searched by the dean without him knowing. This is a misuse of authority because students are conscious, thinking people and they should have protection from their third amendment rights just like any other adult. Lockers are students' personal space just as a house is for an adult. The student that got his locker searched got a lot of days of detention which is unlawful because of the third amendment. THIS IS A MISUSE OF AUTHORITY! People often belittle students and teens because of their age and it is wrong, any student should have the same rights as any adult.
Well I don't think KIDS are going to be taking drugs or something! If someone is caught smoking on campus or something like that then yes they could search. In fact, if administration stuck their heads in students lockers for no reason then it would be against the law. Why don't people understand? Children are people too! Kids are being brainwashed thinking they aren't great and don't deserve rights. Come on people! Think about it!
schools already have lots to do at fault such as over pricing school lunches, not having enough freedom of speech and now to top it off LOCKER SEARCHES! i mean really students deserve at least some privacy at a school environment, schools have the right to read thier papers, look through thier binders and folders and now just to make more problems they are allowing locker searches! they should be banned.
NO LOCKER SEARCHES! I think that there should be no locker searches because kids have to have their own privacy. Some students carry special things from a loved one who had died that was given to them and they hang on to it because it is special to them.
Do you teachers want to do that to a poor little child and make them miserable every second because you took that one special thing that he had in his book bag or locker? So just think about that for a second.
Because an invasion of privacy and students need there privacy no matter what if they don't they will probably loose the schools trust they have for them. I mean what if the teachers got searched by the students and then they would feel the same way. Everybody needs there privacy no matter what anyone says!
When these searches are being conducted they will most likely do anything to find what they are looking for. If they do this then some of your belongings will be damaged and/or broken. Some of those belongings may not be replaceable and if they are replaceable it may be a very expensive and you will probably have to save up a lot of money to replace it. After the statement that I just made you can obviously see that I am against student locker searches.
When I was in school I was taken out of class a paraded down to my locker to open it so that a search could be conducted. The basis of this search was that they smelled pot. I think that fact that they were allowed to do this under current regulations is attrocious since the reasoning was pure hearsay.
Students have personal their lockers. If it was a drug problem just bring a drug dog in to search the school for drugs. It goes against the student's privacy and even though it solves some problems, it does not solve nearly as many as people may think. If something is private and it is in the students locker, it violates their privacy and may allow people to find out something very personal.
No, no, no, no. It is the school's locker, but the students might have private stuff in the locker. I am just hoping that they respect and trust the students, so I say no and no, that they can not search the students lockers. Thank you for reading this debate.
No, I don't think they should because if we don't go through the teachers stuff then they shouldn't have the right to search the students stuff. And if a student doesn't have anything to hide then why should schools have the right to search them? If a school does NOT have a good reason to search students then they dont have the right to search them.
Student may have embarrassing or personal notes or photographs, feminine hygiene products, changes of clothes, or anything else that they wouldn't want people routing through. Some students may have valuable or technological things such as a family ring or a flashdrive in their locker that may get stolen. Although the staff is an important and trusted part of a school, there is no proof that a teacher will not take something from a locker, even if it's by accident. Student's shouldn't feel violated. They pay for and keep their lockers. Teachers have no right digging through their personal objects.
I don't think they should because it is invading our privacy, it is just like us asking if we can go through there desks. Obviously they would say no to that. It is our lockers that the school is providing for us, so if they are wiling to lend us the lockers for the school year then they should have no reason to be going through our lockers. I could understand if somebody had drugs or something that they could use to harm somebody in or outside of the school in there lockers, but if they don't then they should have no reason to be wanting to look in our private lockers.
because its so fuck thing
I think schools should not be able to search students lockers because it is an invasion of privacy. The lockers are rented out to the students so the stuff in the locker belongs to the student. Some students could have some really embarrassing stuff in their locker that they don't want anybody else to see. Also, teachers could abuse the right of searching lockers and torture a student they dislike.
No because the kids need their space and the shouldn't do that because if the student isn't there or if the student doesn't want the teachers to look in the lockers. It is not okay for teachers or the schools to check students lockers. They can get mad or the students would like tell their parents and like I said before, they need their space.
my mom searches my room is that a violation of my privacy? yes it is but shes my mother thats different from a school authority figure searching my locker. lets face it we dont use backpacks nemore.
Students have the right to privacy. They might have personal items that they don't want others to see in their locker, or a student could rely on organization in their locker only for it to be ruined by these checks. It is unfair to good students. It could cause damage - and what if someone framed another person?
They do not have the right that is invading property. It is like someone busting into your house and searching your jacket and your room and your phone and leaving your house in a big mess. You go say something well you were on school property: they do not have the right.
I know this because I myself am a student in middle school and would not like it all if someone went through my locker. I know my friends wouldn't like it either. Some students could have some personal things in their locker that they wouldn't want anyone to see because they could be embarrassed. Its a total invasion of privacy.
The Fourth Amendment in the United States Constitution guards against unreasonable searches and seizures, along with requiring any warrant to be judicially sanctioned and supported by probable cause. Are students not supported by the United States amendments? I say they are. The property In the lockers are the students'. Yes, the lockers are school property, but the belongings inside the lockers are the students'. It violates the Fourth Amendment to go through their belongings without their permission or a court warrant.
I believe that students should have privacy rights as well. Before assigning that locker to the student, the administration should make it clear to the student whether or not the locker can or will be searched. If this is not made clear when the locker is assigned, the student should have a reasonable right to privacy within his locker. If a teacher believes there is something illegal in a kids locker, then the police should be called, and search warrant should be executed.
Yes students need their privacy but how far can the school go to find out whats in the STUDENTS locker? a locker is the students only privacy in the school and i find that unless they dont have a reason to search they should not.but if it is for the better safe of the school they should just search the locker of the person that they think is storing something bad.
If principals check our belongings we should check theirs. And its not fair to us that they are checking ours because it's not like they need anything to see in our lockers, so why do they need to check something that's not theirs? So what is the point of this?
Actually the school doesn't have the right to search lockers because some students have personal things that others shouldn't see and instead of checking a locker why not check the student when they walk in the front door of the school the students don't rent or pay for the locker but it belongs to them for that school year with their personal belongings inside of it.they shouldn't have to worry about their stuff being stolen or accidentally dropped out of the locker while it is being searched
No, No. Of coarse not. The students pay for their privacy, right in the beginning of school. I don't like how so many people are going for student searches because they are most likely teachers and some even parents who don't trust their children. Alot of students, especially teenagers like privacy. If they don't, then there is something wrong with them.
It may be an issue for a small amount of students to hide things such as knives and drugs in their lockers or bags, but the locker and bag space is private! If in these searches they find one knife, or one packet of drugs, how many student's privacy would have been invaded? I wouldn't want people to find out things such as my current grades or how my parents financial situation is. This would only encourage bullying.
Just because SOME students have drugs, doesn't mean you just check all of it! We have our privacy and the school gives us the lockers for the year! This is very wrong and should be stopped immediately! Some people search houses but they have warrants. This may not be important to you but we have some embarrassing and private stuff in our lockers that we don't want to share with anyone but friends.
According to amendment 4 in the Bill of Rights, people have the right to be against unreasonable search and seizures, and they shall not be violated. So, therefore, schools or police should not be able to search your locker, unless for some reason the person searching your locker has a good enough reason to conduct a search.
When the students have their lockers checked without a reasonable cause it is an invasion of privacy and it is wrong to have the faculty search through all of their personal items. It is sad when some one has something like a cell phone at school and it is doing no harm to anyone else but it gets taken away because the school doesn't allow cell phones.
Not only do i believe it is an insult to have someone randomly check me or my locker but its also embarresing to think that i might look like someone that carrys drugs,or any other object that could harm students or the school. I feel like Students shouldnt be checked at random, but should have meteal detectors at school before entering so that a kid wont feel perplexed while being in school.
Sometimes private, personal items are stored in lockers. Schools should not be able to search without a warrant. It violates privacy. The personal information could be used to track students and basically identify personal info such as demographics, location, and others. Students need to be able to remain anonymous and schools don't allow it. If an important ID of an 18 year old in high school was found in a search they can identify that person and steal it for fake identity purposes. Lockers were made for secure storing of items, and schools made them useless. These acts by schools are also considered unconstitutional, so it would also hurt the school by that school being taken to court by a student. Students need to have privacy, but schools just won't allow it.
I think that they shouldn't. Yes, maybe they might something bad but there should be another way. Its not right, its there personal information that would be considered snooping. that is not right what if they have something personal that is just between she or he and family. that is what i think
It is stupid because for one thing it is your own personal privacy not theirs. And you should have the right to say "yes or no" to searching your locker. Not just open it up, lockers are designed in a way to hide their contents for a reason. Otherwise, they'd have open fronts like cupboards.
Searching students' lockers would be an utter invasion of privacy. The point of having a locker is more than having a place to store your stuff. A locker also gives you the freedom to keep certain things hidden. These can include harmless personal items like diaries, love letters and photographs. Searching lockers could embarrass students and others might make fun of them.
Yes, lockers are school property. But that doesn't give schools the right to inspect lockers as they please. While students are using lockers, they have the right to keep their contents private.
Teachers could ask for permission to take a look inside a student's locker, and if the student is okay with that, then it would be fine. Searching students' lockers without their permission would violate their trust. Schools should be a fair and honest place.
As a student myself, I do not believe that schools should have the right to search a students locker unless they have either written or verbal permission from the student themselves. I am very passionate about this topic because I am a student. I would not feel comfortable having a school worker search my personal locker.
I say no, because we would have a lot of private things inside our lockers. I also wonder why schools should check our lockers, because why should they care about what we have inside our locker. I mean that is just awkward when they walk up to your locker and open it and go through it checking every single thing.
It shouldn't be allowed because students have rights and those rights should not be taken away because they have drugs or something in there locker! Students should be able to give permission for teachers or any one else to search there locker. It's fine for police to search your car once you give them permission of course but not for teachers to search students lockers.
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."
Schools need a warrant to inspect a student locker. The Fourth Amendment doesn't apply to just one person or a group of people. It applies to ALL people. INCLUDING STUDENTS. The locker belongs to the school, but the belongings inside it belongs to the student.
1) Its a violation of your personal things and/or self. Even if I did not have anything to hide, I would NOT feel comfortable getting searched. Me and/or my stuff will have been violated!
2) It is against the law to search one or ones things without reasonable suspicion. So technically you need a permit first before searching.
3) You'd still not be making the school and anyone safe. Simple, just because one does not obtain a gun/knife/illegal substance one day, surely does not mean the next day they should of brought one, and surely it is not a very civil thing to check ones backpack daily. That is just absurd!
It is very understandable that a teacher or cop would like to search your locker for drugs, guns, or alcohol. I think that teachers should not be able to do that. Just because the school owns the lockers, that does not mean that they can just go threw your belongings. Therefore I think that it should be illegal. A student might have a very special belonging from a grandparent or a relative that is very special to them. Like I said, they should not be aloud to do anything to a student's locker :) So I would say no teachers, cops, or principles should be able to go threw a students locker.
I understand that the lockers are owned by the school but the school gives them to students 4 the entire year, the kids maintain them and keep them in good shape so they mys well belong 2 the kids its not a storage unit where they can be searched randomly what if the kid has something personal or embarassing their locker they dont want people to see and if the kids see it that kid will be harrased and picked on daily so i think the shouldnt have the right to search students lockers besides its against the U.S. Constitution because to search through someones things or property the need a warrant issued by a judge
Female students need their privacy. Okay most middle school and high school female students are already getting their menstrual cycles. Which they might have pads or tampons in their lockers, this would be embarrassing if the school were to just search them, and if the school requires them to change for gym she might have her extra clothes in the locker. This would be immoral. Even male students could have embarrassing things in their lockers. What if they have their extra clothes for gym in there? Or what if they aren't open about their sexuality? Why risk embarrassing ONE student in front of everyone in the school?
It is absurd, we students need to have our own privacy.
The reason kids get lockers is so they can put things into them and use them for there private things. And if they want to search lockers then they shouldn't have given the lockers to the kids in the first place, if they don't trust the kids with one .
It is the student's property after they pay for it. They keep their personal belongings in there such as their phones, money, etc. However if they have a really good reason to believe that student has done a crime or has possibly been seen with a inappropriate things at school they should be granted the permission. Otherwise, no. They should not allow it.
When I was in high school the counselor and police pulled me out of class during a test. All the students in class looked at me as if I were a criminal, and many students from other classes to as I was being escorted to my locker only to open it for them to find nothing they were looking for. I had to stay after school to complete the test and got home late (I lived more than an hour away) and had no time to study or do homework for the next set of classes I had to attend the following day.
i say no because girls sometimes feel embarrassed to show people what they have in their lockers and its not fair its just invading the students privacy.
Without having a legitimate reason why the students locker is being searched, makes it a violation of the student's rights. There should not be conditions placed upon something that is illegal that makes it okay in certain circumstances. People believe it makes them safer, an example being that the student was carrying a gun. The schools are not prevented from using metal detectors. If someone goes through a detector and it goes off then they have a reason to search their belongings.
If you saw a staff member opening your locker with out permission would you be mad? I've seen staff member opening one my my friend's locker and I was worried. What if you had very private things in your locker? The staff should not be allowed to open lockers with out permission! I mean if the staff said they would be opening people's lockers that's fine but with out permission that's just wrong!
It is invading the privacy of students. They do not have the right to search through a teacher's things, so why do the school staff? "Keep your hands to yourself" needs to come into play here. There is no evidence of searches. They have to know how to have trust in the student body.
1. 4th amendment...absolutely not.
2. Some students live in sad situations where they don't have anything where they can just put things without being stolen or a place that can just be theirs...you shouldn't e snooping.
3. I could talk forever about the faults in education, and students could too...the things that make students frustrated enough to drop out are multiplying, this might push them over the limit, it would to some.
If a student wants to have stuff private he/she should have the right to do so. students should be respected and trusted about what they have in their lockers if thier is a suspesion about the student or if they student has a bad history with getting in trouble then there is reason but if a teach just randomly searches lockers they are wasting time.
Teachers, principals, anybody who works for the school, cannot because if someone works for the government (teachers work for the government) they cannot search personal property without a warrant. I know the whole thing has been through the legislature and they have permission to search your locker because your locker is part of school property, but your backpack has been bought by your parents and that is part of your property. They can search your locker but not your backpack.
what happen if we have something very memorable inside of our belonging or something very special that we want to keep it on the low. example what happen i
the school may own the locker and the locker itself is the schools property, but inside the locker is my own property and it is my right as an american citizen to not be stripped of my life liberty and property! therefore if my locker is searched or my cell phone is taken away the school is obstructing MY OWN personal property, not theirs.
