After all, it is the school's locker. i am doing a debate on this at school and if you look at the statistics, 40 students get shot or killed by fire arms each day. Fourty. i personally would rather have my principal see who i like than get shot by someone because the principal didn't check their locker.

If there is ONE truth, it's that students keep drugs in their lockers. School is a great place to deal drugs... It only makes sense that if the school suspects somethings up, they should check. We need to remember that your locket isn't a private area... It's publicly owned. The school owns it, not you. The only reasons you'd be against the school checking your locker is if you had something to hide. Books, a calculator, some pencils... You shouldn't care if the school looks in and sees these things. When my taxes pay for the lockers, they better be used for legal things.

We could reduce these numbers by having school administrators conduct locker searches, it is valid in cases of reasonable suspicion of possession of weapons and the school has prior rights to lockers since those are part of the school's property and were only lent to students.

When a student goes to school and is assigned a locker, the space is not bought or given to them and there is no contract implied by it's use. While they are free to use, or not use, it as they please they do not have explicit owner ship of the space. So, the searching of said space is at the discretion of the owner. That being the school.

The National Education Association estimates that 100,000 students bring firearms to school every day and forty of those students are harmed because of it. Locker checks will make more students obey school policies in the future and will reduce the risk of school shootings and other dangers. Students will not know when these searches will be therefore they will not bring anything hazardous to school. Teachers may take precautions if they feel that a student may be in the possession of a weapon.

The locker doesnt belong to the student, they have no right to complain that their privacy is being invaded. The only things that should be in that locker are school items and possible electronics, those dont really call for complaint. If theres anything else in the locker that makes the student feel embarrassed it probably shouldnt be in the locker in the first place. Besides, searches keep all students safe and thats all that should matter.

After all, it is your house, and therefore, your rules. It is rude, and therefore shouldn't be used unless there is an emergency. The same applies to schools and their locker searches. I think if there is a reasonable amount of suspicious behavior exhibited by a child at school, the authorities there should be able to search their locker. School children shouldn't be immune to the laws of search and seizure because they are underage. Unfortunately, these days, we all have to be vigilant everywhere. If a kid has something in their locker that could cause harm to himself or to others and there is just cause to open the locker and take a look, then that is what should happen.

The locker searches are only conducted if there is suspicion and a search dog to lead them to the locker. Why would students go against locker searches if they had nothing to hide? The lockers are private and are not being opened and searched publically. The lockers are also part of school property and are a privilege to students that can be taken away. I do not approve of student's lockers being searched without a reason, BUT a public school is a public instituion, administrators should do what is necessary for the safety of other students. And I don't know how other school systems do this but in MY school before getting a locker you sign a warrant that grants the school to search your locker in case they suspect anything such as drugs or weapons etc.. This has never happened at my school but they have the right to and students sign this before getting a locker, so you are already giving them permission. If you have something to worry and dont want to get your locker searched if you are suspectd of carrying a weapon you can just simply not get a locker, you always have that option.

It belongs to the school and the school can use it as they wish. Since it is the property of the school; they can search it whenever they wish. Student's lockers are not personal or private property. The constitution protects us from unreasonable search and seizure of PRIVATE PROPERTY. The school owns the locker and surrounding area. On the other hand, I don't think a random search of backpacks would be reasonable. Backpacks are private property owned by the student. With probable cause, a backpack should become search able, to protect the rights to life, liberty, and the pursuit of happiness for the other students.

That said, I think it is terrible for student morale, and should only be implemented for very compelling reasons. History can teach us a lot of important lessons. One of these is that schools must be able to search lockers, put in metal detectors, etc. It is simply a matter of the safety of the students and faculty. Columbine and Virginia Tech. are prime examples of why this right remains with schools.

Then you get pulled over and the cops search your car and the marijuana is found. You are responsible because the car is in your name. You friend may not even have to go to jail. It is the same with school lockers. If you store something in them the school may get in trouble for it too. Think about it.

Most students believe that a locker search is an invasion of privacy, and I can relate. However, students should bear in mind what they put into their lockers. Don't put anything in a locker that shouldn't be there, such as contraband items and other personal belongings that aren't allowed.

The lockers belong to the school and if you have nothing to hide, then what is the problem? They won't be taking your personal belongings unless they are a danger or threat to the school. It also is not a matter of trust. Every person's locker should be searched just to be safe. There has been cases in my school where someone unwittingly had drugs stashed in their locker because a friend or significant other hid it there without telling them. Once again, the schools would do this to everyone for the safety of all; they are not personally attacking or accusing you by checking your locker.

I understand the whole thing about the safety for the students. If school authorities have a strong enough feel they should be given the right to search the lockers if it is immediate danger. If not it all depends on what the student parent handbook says. If in the handbook it says that teachers have the right then well they have the right. Both of these things could have been prevented if the school would have searched the students bags/lockers. Despite my protests, it was opened and I spent a month in detention for the porno magazines someone else left in my locker. Thank god it wasn't drugs or guns they left. This is a misuse of authority because students are conscious, thinking people and they should have protection from their third amendment rights just like any other adult. The personal information could be used to track students and basically identify personal info such as demographics, location, and others. Students need to be able to remain anonymous and schools don't allow it. If an important ID of an 18 year old in high school was found in a search they can identify that person and steal it for fake identity purposes. Lockers were made for secure storing of items, and schools made them useless. These acts by schools are also considered unconstitutional, so it would also hurt the school by that school being taken to court by a student. Schools need a warrant to inspect a student locker. The Fourth Amendment doesn't apply to just one person or a group of people. It applies to ALL people. INCLUDING STUDENTS. 1) Its a violation of your personal things and/or self. Even if I did not have anything to hide, I would NOT feel comfortable getting searched. Me and/or my stuff will have been violated!
2) It is against the law to search one or ones things without reasonable suspicion. So technically you need a permit first before searching.
3) You'd still not be making the school and anyone safe. Simple, just because one does not obtain a gun/knife/illegal substance one day, surely does not mean the next day they should of brought one, and surely it is not a very civil thing to check ones backpack daily. It is very understandable that a teacher or cop would like to search your locker for drugs, guns, or alcohol. I think that teachers should not be able to do that. Just because the school owns the lockers, that does not mean that they can just go threw your belongings. Therefore I think that it should be illegal. A student might have a very special belonging from a grandparent or a relative that is very special to them. Like I said, they should not be aloud to do anything to a student's locker :) So I would say no teachers, cops, or principles should be able to go threw a students locker.

I understand that the lockers are owned by the school but the school gives them to students 4 the entire year, the kids maintain them and keep them in good shape so they mys well belong 2 the kids its not a storage unit where they can be searched randomly what if the kid has something personal or embarassing their locker they dont want people to see and if the kids see it that kid will be harrased and picked on daily so i think the shouldnt have the right to search students lockers besides its against the U.S. Constitution because to search through someones things or property the need a warrant issued by a judge

Female students need their privacy. Okay most middle school and high school female students are already getting their menstrual cycles. Which they might have pads or tampons in their lockers,this would be embarrassing if the school were to just search them,and if the school requires them to change for gym she might have her extra clothes in the locker. This would be immoral. Even male students could have embarrassing things in their lockers. What if they have their extra clothes for gym in there? Or what if they aren't open about their sexuality? Why risk embarrassing ONE student in front of everyone in the school?

The reason kids get lockers is so they can put things into them and use them for there private things. And if they want to search lockers then they shouldn't have given the lockers to the kids in the first place, if they don't trust the kids with one .

It is the student's property after they pay for it. They keep their personal belongings in there such as their phones, money, etc. However if they have a really good reason to believe that student has done a crime or has possibly been seen with a inappropriate things at school they should be granted the permission. Otherwise, no. They should not allow it.

When I was in high school the counselor and police pulled me out of class during a test. All the students in class looked at me as if I were a criminal, and many students from other classes to as I was being escorted to my locker only to open it for them to find nothing they were looking for. I had to stay after school to complete the test and got home late (I lived more than an hour away) and had no time to study or do homework for the next set of classes I had to attend the following day.

i say no because girls sometimes feel embarrassed to show people what they have in their lockers and its not fair its just invading the students privacy.

Without having a legitimate reason why the students locker is being searched, makes it a violation of the student's rights. There should not be conditions placed upon something that is illegal that makes it okay in certain circumstances. People believe it makes them safer, an example being that the student was carrying a gun. The schools are not prevented from using metal detectors. If someone goes through a detector and it goes off then they have a reason to search their belongings.

If you saw a staff member opening your locker with out permission would you be mad? I've seen staff member opening one my my friend's locker and I was worried. What if you had very private things in your locker? The staff should not be allowed to open lockers with out permission! I mean if the staff said they would be opening people's lockers that's fine but with out permission that's just wrong!

It is invading the privacy of students. They do not have the right to search through a teacher's things, so why do the school staff? "Keep your hands to yourself" needs to come into play here. There is no evidence of searches. They have to know how to have trust in the student body.

1. 4th amendment...absolutely not.
2. Some students live in sad situations where they don't have anything where they can just put things without being stolen or a place that can just be theirs...you shouldn't e snooping.

If a student wants to have stuff private he/she should have the right to do so. students should be respected and trusted about what they have in their lockers if thier is a suspesion about the student or if they student has a bad history with getting in trouble then there is reason but if a teach just randomly searches lockers they are wasting time.

Teachers, principals, anybody who works for the school, cannot because if someone works for the government (teachers work for the government) they cannot search personal property without a warrant. I know the whole thing has been through the legislature and they have permission to search your locker because your locker is part of school property, but your backpack has been bought by your parents and that is part of your property. They can search your locker but not your backpack.

the school may own the locker and the locker itself is the schools property, but inside the locker is my own property and it is my right as an american citizen to not be stripped of my life liberty and property! therefore if my locker is searched or my cell phone is taken away the school is obstructing MY OWN personal property, not theirs.
