Does torturing terrorists in Guantanamo Bay violate the 8th Amendment ban on cruel and unusual punishment?

  • It violates Constitutional AND Human rights

    The US is one of the few developed countries that has not agreed to all sections of the Geneva Convention, a UN ban on torture. This allows them to torture terrorists without UN criticism. On top of that, the 8th Amendment explicitly states that the government may not impose "cruel and unusual punishment". It doesnt matter if they are citizens are not; the government cannot torture.
