Should "date rape" be a lower offense than rape: Would making date rape a separate offense resolve the problem of date-rape incidence going unreported?

  • Its a hard issue

Date rape is a controversial subject, and there are - within the words themselves - different severities of date rape. While its certainly true that no rape is acceptable, a situation involving a person who does not explicitly consent (but never protests) is different than a situation where a person is drugged.

  • No, date rape is just as serious.

No, date rape should not be a separate sexual offense, because that sends the message to offenders that it is not as serious. Sexual contact by coercion is just as heinous as sexual contact by physical force. Anytime sexual activity is not consented to, it should be punished in the same manner. Allowing a date rape defense would lead to false claims of date rape, when the real offense is sexual contact by physical force.
