Should some freedom of speech be limited when that freedom allows people to express hate?

  • People should not be allowed to express hate when it is over the top.

    Many times, people go way over the top. This includes the KKK, and the Church that holds anti-gay rallys at people funeral. I hope for this hate to go away and for people who want to use their First Amendment to use it, but not abuse it. The abuse of the law, needs to stop!

  • This encroaches on nonhateful speech

    When a law was passed related to the funeral protests it wound up being used on someone for having an anti-Bush bumper sticker on his car when he was at a funeral because they said that was a "demonstration".

    And they always write it as "any protest" within a certain distance instead of just narrowly limiting the law to protests directly aimed at the funeral. So the Democrats or Republicans can just hold their conventions right next to a funeral and avoid any protests.

    Furthermore a funeral protest could be based on something other than hate. The protest could be anti-war for example.

  • Silencing hateful opinions seems tantamount to fascism.

    No matter how hurtful or hateful another persons words are to you personally you can choose to ignore them or walk away. And the potential for abuse of some law against hate speech seems to be too high. They could be used to censor an opponents opinions or grievances under the guise of hate speech. In addition to that hate speech is too difficult to define. Is it limited to racism? What about xenophobic or anti-semitic speech? Could bigoted speech be considered a hate crime? I feel I'm making sort of a slippery slope argument here but because hate speech seems so difficult to define and because the only way to stop hateful speech would be through government intervention, I'd be more scared of the government telling me I can't say something than someone I disagree with saying something that hurts my feelings. Those that sacrifice liberty for security deserve neither.

  • Limiting Speech Limits Freedom

    Without the expression of hate, we would not know the opposing arguments. Without instigation, we would not realize if something is corrupt and obstructing our freedoms. In the Constitutional Era, the Constitutional Convention was called to order by James Madison's instigation of the cons of the Articles of Confederation. Therefore, without opposing arguments, we would not know of corruption.

  • If people are protesting

    They probably have a good reason for it. Sometimes it's not even hateful! This, of course, doesn't include physical hate. That wouldn't be freedom of speech anymore. Outside of the physical stuff, the verbal hate should be allowed, because they have reasons, and it doesn't always lead to violence, and the first amendment protects the freedom of speech.

  • Limiting speech will cause people to fear to speak

    When there is a society that restricts speech it becomes a society in which there is no controversial politics, art or ideas which all contribute to shaping a society and limiting it will stunt the growth of said society causing a negative effect which will set it back and cause it to fail.

  • Every opinion needs to be heard

    Freedom of speech is so important as what is 'wrong' to one person is a valid opinion to another. There is no definite 'right' and 'wrong'. If people believe in something, they should be able to express that viewpoint. In the modern world, people are too quick to call people offensive, racist, sexist, discriminatory etc. Everything you say will be offensive to someone, but we all have the right to share are opinion.

  • True Freedom of Speech is Unlimited.

    Free speech is a double edged sword, as anything is. It is sad that people would be used to express hate, but it is their freedom to do so. As Voltaire stated long ago: "I do not agree with what you have to say, but I'll defend to the death your right to say it." The Founding Fathers put nothing in the Bill of Rights that said "Freedom of speech, unless it hurts someones feelings." It is your speech, and you get to choose what to say. That is true freedom.

  • Then that would not be freedom of speech.

    People should be able to express whatever it is they would like, as long as it is not endangering anyone. If it is simple hate speech that can only effect someone emotionally then that is the person's own problem. You cannot avoid all of the bad in life, you must embrace it and learn from it. Suck it up and deal with it. You just can't physically hurt someone.
