Should terrorists be tried in the same courts as U.S. citizens?

  • It should Say SUSPECTED Terrorists

    How do we know they are terrorists if we do not give them fair trials? How do we know they did anything wrong? In fact many were caught by bounty hunters out to make a buck and very little questions are asked to make sure the bounty hunter hasn't just made up a story to get money. Yes, they should be tried in the same courts. Otherwise I don't trust the government when it says these people are terrorists. I demand PROOF!

    Here's the problem. Not trying terrorists in the court system means that an accusation of terrorism means an indefinite detention. This gives the government authority to lock up any person they wish just based on an accusation. The court system is in place to make sure the government actually has evidence that a crime was committed.

    The perpetrators of the first attack on the World Trade Center were effectively tried and convicted in civilian courts. There is no need to do something else. Besides, creating military tribunals is partly giving the terrorists what they want: notoriety. They are not special people; they are common criminals and deserve to be treated as such.

  • You don't have to prove them guilty "beyond a reasonable doubt" in civilian court.

    In a criminal court, the burden of proof is "beyond a reasonable doubt." In a civilian court, it is "harm" or 51%. This means that if two people get into a fight and beat each other up but one guy has slightly more damage, he can sue the other one. There is no reasonable doubt. Only harm. TRYING TERRORISTS IN CIVILIAN COURTS MAKES IT EASIER TO ATTAIN A CONVICTION!!!

    Terrorists being held in the United States should be tried under the same laws we have for civilians who are American citizens. It doesn't matter if they are from another country--on American soil, terrorists are tried by American laws if they killed American citizens as acts of terror. The detainees in Gitmo should have been tried and convicted years ago.

    Yes, I believe that terrorists should be tried in the same courts as US citizens. Although many critics of this policy will say that by doing this, the United States government will be putting its citizens at risk, the truth of the matter is that the US Government is more than capable of providing adequate security during the trials and any backlash. If we hold ourselves to a certain standard, then we should hold ALL others to that same standard, and by holding these trials in the United States, we can guarantee that these people will get fair trials, and if they indeed are guilty of terrorist acts against the country, they will be punished for them.

    The Geneva Convention and other NATO/UN military laws protect our soldiers from getting tried in civilian court for murder by following the rules of war and the AUMF. Some of these rules include the open carrying of weapons and restricting soldiers from double-tapping enemies. Terrorists do not abide by these laws of war that the rest of the world follows thus making themselves unlawful combatants. By not conducting war in a manner that is friendly to civilians they should not merit due process in civilian court.

    Terrorists who are not U.S. Citizens and have attacked the U.S. Are criminals of war and should be tried in military courts as military combatants. They are not citizens of the U.S. And as such they do not deserve the same rights and privileges that we have. Our system is crowded enough, and we don't need terrorists clogging it up any more than it already is!

    Only American Citizens have rights to be tried in U.S. Courts. Anyone caught terrorizing America or its citizens should not be tried but punished for their acts. American citizens caught in terrorist acts against America should forfeit their rights to be tried in America. They made their choice when they turned against their fellow citizens.

    If they are prisoners of war or military conflict, it is the military's responsibility. This assumption that military trials are not fair is BS.

  • Terrorist need to be tried in a Military Court!!!

    They are terrorist that commit act of war and should be tried in military courts as military combatants. They are NOT civilians and further more are NOT US Civilians! The argument of a fair trial in a civil court blows my mind, I cannot fathom the US court system being able to give a swift enough punishment. Locking them away for the rest of their lives in a normal prison is probably a better life than what they had in their own country.
