    Republicans in Congress have been trying for several years to pass a national 20-week abortion ban. It’s also very possible, given the latest anti-abortion lawmaking trends at the state level, that Congress would try to pass a national ban on dilation and extraction (D&E), the safest and most common method of performing a second-trimester abortion. A D&E ban wouldn’t explicitly outlaw second-trimester abortion, but the practical effect would be almost the same.
    Both of those laws would fly in the face of Roe because they would ban abortion, either outright or effectively, before a fetus is viable. So either of those laws would probably be challenged.

    It is very true that Donald Trump will actually overturn Roe v. Wade. This is actually evidenced by the power that Donald Trump has acquired as the president of the United States of America. The other reason is how Donald Trump is so arrogant and does everything that is in his interest.

    No, because it wouldn't and can never stop abortions. Illegal abortions end up costing the country more (if you take the financial argument) and are far more dangerous (if you're concerned with maintaining life). Pro-life can't mean a mother and a child may both die if a complication requires an abortion.

    He might reduce some of the power that it has, but it would be very difficult, in fact almost impossible for him to get it overturned. There is vey little chance that he would be able to do anything to get it overturned, as he does not have that kind of power

  • Roe v Wade was a Supreme Court Decision

    The only way Trump could effectively overturn roe v wade would be with a constitutional amendment or by appointing supreme court justices which would decide a similar case differently in the future. Both of these are highly unlikely. The controversy behind abortion would make an amendment difficult to ratify and even justices appointed by trump would be reluctant to overturn a prior supreme court ruling because of "Stare Decisis" which prompts judges and justices to refrain from disturbing a settled point of law. Trump may however try to pass legislation which circumvents roe v wade by defunding planned parent hood and other such legal circumvention.

    Although Trump ran on the platform that he would overturn Roe v. Wade with his election, I do not think he will have the power to do this. More than half of the U.S. population supports the right to choose and the president cannot singlehandedly overturn a law which the majority of Americans support and has been in place for several decades. He also does not currently have the capacity within the Supreme Court to overturn Roe v. Wade so without a change in the Supreme Court makeup, it would not be possible for him to attempt to change this law.
