My stance on the Death Penalty: While I support rehabilitation in as many cases as possible, there are some cases where the Death Penalty is the best option. I only believe that the DP (Death Penalty) will be of absolutly no value when we have the option of completely (with 100% certainty) brainwashing criminals to esentually make them into &quot;new&quot; people.

Now, in order for this debate to really mean anything, my opponent and I will have to agree on what the purpose of the justice system is for. If my opponent would like, she may reject the challenge, we can talk via PM to come to some kind of agreement, and re-start the debate.

The death penalty would deter some future murders because some people who want to commit murder won't do it because they know that they will get killed if they do so. Studies have shown that it deters crime. Most criminals don't want to die. The death penalty should be done in a painful, harsh way so that it would be more likely to deter crime. Some People will be scared to commit murder if the death penalty is done by getting shot with a gun.

<description>(Post Voting Period) Ahhh, the death penalty. The government taking someone's life because they took someone else's life. What obvious hypocrisy.

I disagree with the death penalty because it is immoral.

First, the death penalty implies that a jury of twelve people is qualified to take life into their own hands. Does this mean that mob execution should also be made legal?

Second, the death penalty becomes intolerable the very moment that someone is wrongly convicted. Death is, if anything, permanent. If someone is wrongly convicted and sent to life in prison its horrible, but if someone is wrongly convicted and sentenced to death, then an innocent person is MURDERED. How can this be moral?</description>

<description>(Voting Period) I contend that the death penalty is a just punishment for certain types of crimes. The reasoning for this is rooted in basic positive AND negative rights - namely the right to life, the right to defend oneself, and the right to redress of grievances for harm to oneself or one's companions.

I don't think anyone contests the notion that there is a basic right to live. In order to exercise this right, we must have a right to defend that life, either by incapacitation or fatality. Furthermore, grounded in this, we must also have the right to strike back when harmed. It makes little sense to state that the right to strike back is limited to a lesser extent than we were harmed.

In social contract theory, when one violates the rights of another, he negates what rights he DID have while in the contract and removes himself from those rights.
