Does the US Second Amendment have authority over states: Does the Second Amendment have authority over state governments?

  • The Constitution Always Takes Precedence

The constitution always takes precedence over state law, and that includes all the amendments including the second amendment, the right to bear arms. This is a part of the bill of rights, one of the most important documents in American history, and nothing should be able to infringe on these basic rights.

  • It's the Constitution

I'm all for gun control. Study after study shows that a gun in your house is FAR more likely to be involved in an accident or suicide then it will be used to protect you from a home invader. I believe that we as a nation need to rethink out gun culture.

That being said, any new gun restrictions must comply with the Second Amendment. The Constitution of the United States is the foundation of our country and our government. There is absolutely no legal precedent for a state government to ignore the Constitution.
