Is this Scenerio discrimination ?

A Jewish owned bakery recieves an order from a Neo-Nazi member to add a swatstika to the cake and hitlers signature. The Jewish family obviously denies the order. But the neo-Nazi member forces the Jewish bakers of discrimination. Is this scenario discrimination ?

1) Theyre not discriminating against them for being neo nazis. They dont provide swastika cakes. A gay couple isnt asking for a soecially designed gay eedding cake they just want a cake. You can t refuse them just for being gay. 2) You cant discriminate on gender, relgion, race, or sexuality. Political views are an entirley different matter.

@Itani: Under that logic, is it true that a lot of European countries are 'discriminating' for banning Nazi symbolism and Holocaust denial? I agree that you can't be charged for *having* a political ideology, but if you *act* on a racist one, such as ordering a cake with Hitler's signature, you should be punished for that.

I don't agree. Banning symbols (even if they represent racism) is also banning freedom. People can believe in what they want to, as long as it's not breaking any other laws.

@Diqiucun Yes, it definitely does mean that. But that doesn't mean that it's bad. One could argue that discriminating against nazis is a good thing.

So you are saying that it is ok for baker to refuse making a gay wedding cake, but they can't refuse making a normal wedding cake to a gay wedding?

@kman10: If we're going to use the technical meaning of discrimination, by definition everyone should vote 'yes'. In fact, the answer to 'Is selling things discrimination?' should be 'yes' because using price competition (or any other form of competition) to allocate resources inevitably involves discrimination. I think the OP implied in the word 'discrimination' a negative light.

You cannot punish someone for holding a certain set of beliefs, especially since you are doing so only because you disagree. Communists should be allowed to be communists, and Nazis should be allowed to be Nazis.

As for the cake, the baker has the right to refuse to modify this cake, as it is still their property until transaction. This has no parallels to gay people harmlessly buying products, unless they specifically ask for a cake modified to support their cause.
